1. Acceptance of Terms

By using OtterFax, you agree to these terms. If you don't agree, please don't use the service. OtterFax is a product of EthDen LLC.

2. Proper Use

Don't use OtterFax for anything illegal. Specifically:

  • No spamming via fax or shortened links.
  • No transmitting malicious software or copyrighted material you don't own.
  • No attempting to bypass our rate limits or identity verification.
  • Custom short codes must adhere to our Professional Code Policy. We reserve the right to block or remove any codes that contain offensive or inappropriate language.

3. Sender Responsibility & Non-Anonymity

OtterFax is a non-anonymous service. To maintain the integrity of the platform and comply with telecommunications standards, every fax transmission includes a mandatory cover sheet footer containing the sender's verified email address and phone number.

You are solely responsible for the content, accuracy, and legality of any document you transmit. OtterFax does not screen the contents of your faxes and acts only as a transmission utility.

4. Payments & Metered Billing

Subscriptions are billed monthly. By using OtterFax, you explicitly authorize EthDen LLC to automatically charge your stored payment method for any "Soft Cap" metered billing overage fees incurred when you exceed your tier's monthly page limit. One-time fees for excess pages are billed immediately or at the end of the billing cycle. All sales are final, though we will provide refunds if a technical error on our part prevents your fax from being sent.

5. Data Storage, Retention, & Liability

OtterFax implements a strict 30-day data retention policy for all standard documents and files. 30 days after creation, your data is permanently deleted from our servers.

LIABILITY DISCLAIMER: OtterFax does not provide long-term automated backups. You are solely responsible for archiving your data using our Google Drive integration or downloading files locally. EthDen LLC is expressly not liable for any data loss, damages, or business interruption resulting from the routine deletion of un-backed-up data after the 30-day retention period.

6. Disclaimer of Liability

We strive for 100% reliability, but we provide our tools "as is." EthDen LLC is not liable for any damages resulting from a delayed fax, a broken link, or a lost document.

7. Termination

We reserve the right to suspend accounts that violate these terms, especially those involved in spam or fraudulent billing.

8. Electronic Signatures & Data Retention

By using the OtterFax E-Sign service, you acknowledge and agree that:

  • Legal Binding: Electronic signatures created via OtterFax are intended to be legally binding and carry the same weight as physical signatures under the ESIGN Act (U.S.) and eIDAS (EU).
  • Mandatory Retention: To ensure the legal integrity of signed documents, OtterFax is required to maintain a permanent, immutable record of all signing transactions. This includes the signed PDF, timestamps, IP addresses, and signer identities.
  • Audit Hold: You agree that even if you delete a document from your user dashboard, OtterFax will maintain a secure copy of the signed document in "Audit Hold" for legal and regulatory verification purposes. These records will only be accessed in response to valid legal inquiries, court orders, or required compliance audits.
